Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website and the Inner Reset course provided by Claudia Thomas, trading as Second Chances by HummingBird ("we," "us," "our"). By creating an account, purchasing, or using the course, you agree to these Terms.

1. The Course

Inner Reset is a one-time-purchase digital self-paced course. It includes five guided modules and a private reflection journal. The course provides educational and personal-development content only. It is not medical, psychological, therapeutic, legal, or financial treatment or advice and is not a substitute for care from a licensed professional. If you are in crisis or require professional support, please contact a qualified provider in your area.

2. No Guaranteed Outcomes

We do not promise or guarantee any specific personal, emotional, financial, spiritual, or health outcomes from your use of the course. Results depend on individual effort, circumstances, and many factors outside our control.

3. Account & Eligibility

You must create an account to access paid course content and must be at least 18 years old (or the age of majority in your jurisdiction). You are responsible for the accuracy of your registration information and for protecting your login credentials. Notify us immediately of any unauthorised use of your account. You may not share your account or course access with others.

4. Pricing, Payment, and Merchant of Record

The course is offered for a one-time payment of US$147, including any applicable taxes shown at checkout. Payment unlocks lifetime access to the purchased digital course, subject to these Terms.

Our order process is conducted by our online reseller and authorised merchant of record, Paddle.com Market Ltd. Paddle is the Merchant of Record for all our orders. Paddle handles order-related matters such as payment processing, taxes, invoices, receipts, billing, refunds, and chargebacks. Second Chances by HummingBird remains responsible for course content, access, and product-related support. Paddle's current Buyer Terms apply to your purchase and are available at paddle.com/legal/checkout-buyer-terms.

5. Lifetime Access

"Lifetime access" means access for as long as the course continues to be operated, subject to these Terms. We do not promise that the platform or course will be available perpetually. If the course is permanently discontinued, we will provide reasonable advance notice and, where reasonably possible, offer an alternative method of accessing purchased course materials.

We may suspend or terminate access for material breach of these Terms, non-payment, fraud, abuse, security risk, or repeated policy violations. If access is revoked due to a refund or chargeback (see our Refund Policy), your license to the course ends.

6. License & Intellectual Property

All course materials — including videos, audio, text, images, journal prompts, and design — are owned by Second Chances by HummingBird and protected by applicable IP laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access the course for your personal, non-commercial use. You may not copy, download beyond personal use, redistribute, resell, sublicense, reverse-engineer, or use the materials to train any AI or machine-learning model.

7. Acceptable Use

  • No unlawful, fraudulent, or harmful use of the website or course.
  • No interference with security, no probing, scraping, or malware.
  • No infringement of intellectual property or others' rights.
  • No sharing or reselling of access, content, or credentials.

8. Reflection Journal & User Content

Reflection journal entries you save are stored for your private use. You can clear your saved journal entries at any time through the application. You retain ownership of your content; you grant us a limited license to host and process it solely to provide the course features to you. Do not enter sensitive personal information you would not want stored.

9. Disclaimer of Warranties

The course is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to these Terms or the course is limited to the amount you paid for the course. We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be limited by law.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Claudia Thomas, trading as Second Chances by HummingBird, from third-party claims or losses arising directly from your unlawful conduct, infringement of another person's rights, unauthorised redistribution of course materials, or material breach of these Terms.

12. Suspension & Termination

We may suspend or terminate your access for material breach, non-payment, fraud, security risk, or repeated policy violations. On termination, your license to the course ends. Provisions that by their nature survive termination will survive.

13. Changes to the Course or Terms

We may update the course, the website, or these Terms from time to time. Material changes to the Terms will be posted on this page with an updated date and, where appropriate, communicated by email.

14. Governing Law

These Terms are governed by the laws of Barbados, except where mandatory consumer-protection laws of your country of residence apply.
